Was Your Uninvested Cash Earning Almost Nothing While Interest Rates Hit a 20-Year High?

Between 2022 and 2025, the Federal Reserve raised its benchmark rate from near zero to over 5%. Many brokerage, retirement, and advisory firms automatically moved their clients’ uninvested cash into bank deposit programs that appear to have paid far less. Our firm is investigating several of those programs. If you held cash at one of the financial institutions below, a free and confidential review is available.

The Basics

What Is a Cash Sweep Program?

When you hold cash in a brokerage, retirement or investment advisory account — money waiting to be invested, proceeds from a sale, or a dividend payment — most firms do not simply leave it sitting there. They automatically transfer it, or “sweep” it, into a bank deposit program. Your cash is deposited at one or more banks, and you earn interest on that deposit.

The firm sits in the middle of that arrangement. The bank pays the firm for the deposits it brings in, and the firm passes some portion of that along to you as interest. The difference between what the bank pays and what you receive is known as the spread, and it is revenue for the financial institution.

A spread is not unusual on its own. What our investigations examine is what happened to that spread between 2022 and 2025 — the fastest rate-hiking cycle in four decades. As market rates climbed past 5%, the rates paid to sweep clients at a number of firms appear to have barely moved.

Why 2022–2025 matters
The gap between prevailing market rates and sweep rates widened sharply during this period. Where a firm’s own disclosures promised that rates would be set based on prevailing market or economic conditions, that gap may raise contract and fiduciary questions — particularly for investment advisory clients, who are owed a continuous duty of loyalty and care.

FREQUENTLY ASKED QUESTIONS

Common Questions About Cash Sweep Investigations

It is an automatic arrangement that moves uninvested cash out of your brokerage or advisory account and into one or more banks, where it earns interest. The firm arranges the deposits and is compensated by the bank. The portion the firm keeps, rather than passing along to you as interest, is the spread.

Because of what appears to have happened during the 2022–2025 rate-hiking cycle. As market rates rose above 5%, the interest rates paid to sweep clients at a number of firms appear to have stayed low. Where a firm’s own account agreements or disclosures stated that rates would reflect prevailing market or economic conditions, that gap may raise contract and fiduciary questions. Each investigation examines a specific firm’s own documents and rates.

A class action allows one or a small number of people to bring claims on behalf of a larger group who were affected in a similar way. An investigation comes earlier: it is the stage where a firm gathers information from current and former clients to evaluate whether claims exist and whether they can be brought. An investigation does not mean a lawsuit has been filed, and it does not mean any firm has been found to have done anything wrong.
No. Former clients who held accounts during the relevant period may also be eligible. Eligibility periods differ by firm, so see the page for your specific firm.
There is no cost to submit a form or to have your potential claims evaluated in an initial consultation. There is no obligation or commitment on your end unless and until a client agreement is signed.
Potentially. Legal claims are subject to statutes of limitations — time limits that can extinguish a claim once too much time has passed. These periods vary by state and by the type of claim. Because the conduct under investigation may date back to 2022, we encourage you to submit your information promptly so timeliness can be evaluated.
Yes. Information you submit is kept confidential, and it becomes protected by attorney-client privilege once an attorney-client relationship is established. Submitting a form by itself does not create that relationship.
A member of our team will review your information and contact you, typically within one to two business days, to discuss whether your situation may qualify. There is no obligation to proceed.
